The General Data Protection Regulation, is set to be more inclusive than the existing Data Protection Act 1998 (DPA). It will have a wider scope to further protect individual's personal data. It is also designed to provide consistency in data privacy laws across Europe. Businesses need to be informed of this new regulation and how it can affect them.
If you are a data controller or a data processor of personal information, GDPR applies to you. The GDPR is a single Regulation that will be adhered to by all Member States and is designed to give control of personal data back to the individual EU resident. However, there will be some significant changes. If you currently have to comply with the DPA, you will need to be GDPR compliant. The new regulation encompasses all personal data. This includes name and addresses, and sensitive personal data (such as religious and political views).
If companies fail to meet GDPR Compliance 2018, there is a new fines regime in place. This means that if data is breached, businesses and authorities could face large fines. As of May 25th 2018, any and all data breaches must be reported to the UK Protection Regulator. Breaches must be reported to the Information Commissioner's Office (ICO) within 72 hours.
